Terms of Service

Applicable Terms

These Terms of Service apply to https://interiordesignerprotectionplan.com and any affiliated websites (collectively, the “Sites”) owned and operated under the “Interior Designer Protection Plan” brand by RAP, Inc. and its licensed protection plan agency affiliate, RAP Protection Plan Agency, Inc. (collectively, “We”, “RAP”, or the “Company”). By using the Sites, you agree to these Terms, in addition to our Privacy Policy (“Privacy Policy”), which together constitute the “Terms”.

Service

RAP operates as a portal to facilitate connections between interior designers and third-party protection plan providers (“Providers”) offering protection plans tailored to professional and business-related risks in the interior design industry. The Service allows you to compare protection plans offered by Providers. Our Service is free for you to use, and we may receive commissions or fees from Providers participating in the Service.

The Service is available only to residents of the United States, and protection plans may not be available in all states due to varying insurance regulations. You may not use the Service or accept these Terms if you are not of legal age to form a binding contract with RAP or are legally prohibited from using the Service under the laws of your state of residence or access.

RAP is a licensed protection plan agency, not a protection plan provider. Protection plans are offered by Providers, not RAP, and their terms and conditions are determined by the Providers based on their underwriting criteria. We do not provide advice or endorse specific protection plans or Providers. It is your responsibility to ensure any protection plan meets your specific needs as an interior designer. Quotes provided through the Service are estimates from third parties, and RAP does not guarantee their accuracy or availability. Actual rates and availability depend on additional information provided to Providers during the application process.

Warranties and Disclaimers

We provide the Service with a commercially reasonable level of skill and care, but we do not make specific promises about the Service’s content, functionality, reliability, or ability to meet your needs. The Service is provided “AS IS.” To the extent permitted by law, RAP and its Providers exclude all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Liability of Our Services

To the extent permitted by law, RAP and its Providers are not liable for lost profits, revenues, data, financial losses, or punitive damages. RAP’s total liability for any claims under these Terms is limited to the amount you paid to use the Service (or, at our discretion, to re-providing the Service). RAP and its Providers are not liable for any loss or damage that is not reasonably foreseeable.

Prohibited Activities

The content and infrastructure of the Sites are proprietary to RAP. You agree not to:

  • Use the Sites for commercial purposes without our express permission.
  • Access, monitor, or copy content using automated means (e.g., robots, scrapers) without written permission.
  • Violate robot exclusion headers or bypass access restrictions.
  • Impose an unreasonable load on our infrastructure.
  • Deep-link to any portion of the Sites without permission.
  • Frame or mirror any part of the Sites without authorization.
  • Attempt to modify, reverse-engineer, or decompile software used by RAP.

Phone, SMS, and Email Communications

By providing your contact information and clicking “Continue” on any prompt, you consent to receive marketing communications about protection plans via phone, SMS, or email from RAP and its marketing partners at the provided contact details, even if your number is on the Do Not Call Registry. Consent is not required to receive quotes; you may call (866) 749-1973 for quotes without consenting to marketing.

To opt out of SMS, text “STOP” to the sending number. You will receive a confirmation message, and no further SMS will be sent unless you re-subscribe. For help, reply “HELP” or contact hello@interiordesignerprotectionplan.com. Message and data rates may apply, and you may receive up to 15 messages per month. Carriers are not liable for delayed or undelivered messages.

Governing Law

These Terms are governed by the laws of Massachusetts. All claims arising from these Terms will be litigated exclusively in the federal or state courts of Middlesex County, MA, and you consent to personal jurisdiction in those courts.

Indemnity

You agree to defend, indemnify, and hold harmless RAP and its partners from any losses, claims, damages, or expenses (including legal fees) arising from your use of the Sites or breach of these Terms. RAP may participate in the defense of any claim at your expense.

Dispute Resolution

To the fullest extent permitted by law, all disputes between you and RAP will be resolved by binding arbitration, not in court or by jury trial. You waive the right to participate in class actions or class arbitration. Arbitration will be conducted in Broward County, FL, under the rules of the American Arbitration Association.
